Disputes

Any dispute relating in any way to your visit to this website or to products you purchase from us shall be arbitrated by state or federal court in Boston, Massachusetts, and you consent to exclusive jurisdiction and venue of such courts.

You agree to indemnify Paradigm Works, Inc., and its affiliates and hold us harmless against legal claims and demands that may arise from your use or misuse of our services. We reserve the right to select our own legal counsel.

Limitation on liability

Paradigm Works, Inc., is not liable for any damages that may occur to you as a result of your misuse of our website.

Paradigm Works, Inc., reserves the right to edit, modify, and change this Agreement at any time. We shall let our users know of these changes through electronic mail. This Agreement is an understanding between Paradigm Works, Inc., and the user, and this supersedes and replaces all prior agreements regarding the use of this website.

Refund and Payment Policy (Last Updated on March 30, 2023)

PLEASE READ IT CAREFULLY BEFORE MAKING A PAYMENT AS IT DETERMINES YOUR RIGHTS WITH REGARD TO YOUR PURCHASES, INCLUDING ESSENTIAL RESTRICTIONS AND EXCLUSIONS.

Paradigm Works, Inc., strives to ensure a clear understanding of financial relations between open enrollment course participants with respect to the training services we provide. This policy applies to all open enrollment training services and digital training materials made available through the Website and any related product or service owned and provided by Paradigm Works, Inc.

Cancellation of a Training Course

Canceling or postponing of a training course without any fees is only possible up to five (5) business days before your scheduled training course start date. Any request to cancel or postpone a session shorter than five business days beforehand can under no circumstances be refunded. Still, course credit will apply and can be used within one calendar year from the date of the original training course.

Once a training course commences, you are excluded from the right of withdrawal and can under no circumstances be refunded. We reserve the right to charge the cost of the training course that is canceled less than 5 business days before its start date, without the possibility of this amount being refunded to the course participant.

You can reschedule a training course by contacting us at sd-training@paradigm-works.com. You will be asked to provide a reason for your cancellation/rescheduling request.

Refund Procedure

You are required to send your refund request to sd-training@paradigm-works.com. The refund decision shall be made up to 30 calendar days. To the fullest extent permitted by law, any refunds at any time are at our sole discretion only.

Expired Balance of Training Course Credit

With a duration of 365 (three hundred sixty-five) days following the payment, your remaining balance will be considered expired and will be irreversibly lost and nonrefundable.

Payment Services

We use third-party payment services to bill you through an online account payment. Correspondingly all transactions are secured, and all payment information is stored securely by Intellipay. For more information about their security conditions, please visit the Intellipay website www.intellipay.com. Paradigm Works, Inc. does not store your payment information on our servers.

Data Provided by You

Paradigm Works Inc. does not collect, store or otherwise process your billing information. You agree that Paradigm Works, Inc. will not be responsible for any failures of the third party to adequately protect such information. The processing of payments will be subject to the terms, conditions, and privacy policies of our partners-payment providers in addition to this policy.

You acknowledge that we may change our partners-payment providers and require them to securely transfer your information to other service providers that secure your information.

Payments and Taxes

All payments shall be made through Intellipay (www.intellipay.com). The open enrollment course participant will be liable for all transaction fees on the services related to the delivery and consumption of services through the Paradigm Works, Inc. website (www.paradigm-works.com). Parties are responsible for paying all fees and applicable taxes associated with the delivery and consumption of services through the Paradigm Works, Inc. website and for using the tools with a valid payment method.

Other

Paradigm Works, Inc., is not a bank or any type of financial institution, we do not provide any financial services or advice. Any payments made via our website are made solely for the purpose of consumption and delivery of training services as advertised on www.paradigm- works.com and www.sunburst-design.com.

Such payments may not be made and used for any fraudulent, criminal, or illegal activity as defined by the law.
